Introduction This Guest WiFi Use Agreement (“Agreement”) outlines the terms and conditions for accessing and using the guest WiFi network (“Network”) provided by Juan Andres Martinez (“Provider”). By using the Network, you (“User”) agree to comply with the terms outlined below and are responsible for your guest’s compliance. If you do not agree to these terms, please do not use the Network.
1. Acceptance of Terms By using the Network, you agree to be bound by this Agreement. The Provider reserves the right to modify these terms at any time, and such modifications shall be effective immediately upon posting the modified terms. Your continued use of the Network constitutes acceptance of any such modifications.
2. Authorized Use The Network is provided for the sole purpose of offering temporary internet access to guests. Unauthorized use of the Network is strictly prohibited. You may not use the Network for any unlawful or harmful activities, including but not limited to:
- Distributing, downloading, or transmitting illegal or infringing content.
- Engaging in any activity that disrupts or interferes with the Network or any other user’s ability to use the Network.
- Accessing or attempting to access the accounts, devices, or data of others without permission.
- Engaging in any form of network abuse, including excessive bandwidth usage.
3. Privacy and Monitoring The Provider respects your privacy but reserves the right to monitor Network usage to ensure compliance with this Agreement, to protect the Network, and to comply with applicable laws. The Provider may collect, store, and use information related to your use of the Network, including but not limited to:
- Device identifiers.
- IP addresses.
- Bandwidth usage.
- Websites visited and services accessed.
4. Security The Provider takes reasonable steps to secure the Network, but cannot guarantee the Network’s security. You are responsible for ensuring that your device(s) have appropriate security measures in place, such as updated antivirus software and secure passwords. The Provider is not responsible for any security breaches, loss of data, or damage to your device(s) that may occur as a result of using the Network.
5. Limitation of Liability The Network is provided “as is” without any warranties of any kind, either express or implied. The Provider is not liable for any direct, indirect, incidental, special, or consequential damages that may result from the use or inability to use the Network, including but not limited to loss of data, loss of profits, or interruption of service.
6. Indemnification You agree to indemnify, defend, and hold harmless the Provider, its officers, directors, employees, and agents from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Network, your violation of this Agreement, or your infringement of any intellectual property or other right of any person or entity.
7. Termination The Provider reserves the right to terminate or suspend your access to the Network at any time, without notice, for conduct that the Provider believes violates this Agreement or is otherwise harmful to the Network, the Provider’s interests, or any other user.
8. Governing Law This Agreement shall be governed by and construed in accordance with the laws of Texas without regard to its conflict of law principles. Any disputes arising out of or related to this Agreement or the use of the Network shall be resolved in the courts located in Texas.
9. Entire Agreement This Agreement constitutes the entire agreement between you and the Provider regarding the use of the Network and supersedes all prior or contemporaneous understandings and agreements, whether written or oral.
